Thank you for your request of 27 September 2019 asking for information relating to British Transport Police facilities.

Your request has been considered in accordance with the requirements of the Freedom of Information Act and our information access policy.  I can confirm that we do hold some of the information that you have requested. You asked:

For Finsbury Park, Wembley Park, Hammersmith and Stockwell these leases form part of wider arrangements independent of any specific PFI obligations.

We do not hold the commercial arrangement for Central London Police Station as it is independent of TfL. You can request a copy of the arrangement from the BTP by emailing [email protected] or write to:

Other leases are arranged between TfL and other parties and are therefore not subject to the PFI contract.

In accordance with the FOI Act, we are not obliged to disclose the annual cost of the arrangement where we have a commercial arrangement with another party as it is subject to a statutory exemption to the right of access to information under section 43(2).

In this instance the exemption has been applied as disclosure of the information you have requested would be likely to prejudice our commercial interests. Disclosing financial information would be likely to prejudice our commercial interests as it would be likely to adversely affect the amount we obtain through our future negotiations with commercial partners.

The use of this exemption is subject to an assessment of the public interest in relation to the disclosure of the information concerned. TfL recognises the need for openness and transparency by public authorities, particularly where the use of public assets, but in this instance the public interest in ensuring that TfL is able to obtain the best value from public assets, outweighs the general public interest in increasing transparency of TfL’s processes.

[1] *SS(BTP) – Support Services (BTP) – Amey is the facilities management provider for Support Services (BTP) and is a subcontractor as part of the PFI Contract. There is no direct contractual relationship between Amey and TfL.
