Please can you provide the details of the new YUNEX/Siemens contract for the whole of the ULEZ and Traffic Light Control systems, it doesn't appear to be on line

Thank you for your email received by Transport for London (TfL) on 4 September 2023, and following clarification, 26 September and  6 October 2023, asking for contract details.

Your request has been considered in accordance with the requirements of the Freedom of Information Act and our information access policy.  I can confirm that we hold the information you require. You asked for:
 
  • Full details of the equipment and systems?

Please see the attached PDF for the list of the equipment/systems being maintained under this contract, which is provided in the format we hold.
 
  • Annual costs of the equipment and systems?

In accordance with the FOI Act, we are not obliged to supple the information for this part of your request as this information is determined to be commercially sensitive and is subject to a statutory exemption to the right of access to information under section 43(2).

In this instance the section 43(2) exemption has been applied to information regarding the annual costs charged by our supplier as disclosure would be likely to prejudice our commercial interests, as well as those of Yunex. Prejudice would be likely to occur when we go out to tender for this and similar services in the future because it would be likely to result in a clustering of bids based on how much we are prepared to pay. Disclosing this information could also be prejudicial to our supplier’s ability to compete for tendering opportunities with TfL and other companies in the future, as their competitive edge would inevitably be prejudiced by disclosure of a detailed breakdown of their pricing structure. Additionally, as the information concerned has commercial value, it is therefore liable to cause real (or significant) harm to Yunex and be advantageous to any rivals. Reasonable steps are therefore being taken to keep these costs secret.

The use of this exemption is subject to an assessment of the public interest in relation to the disclosure of the information concerned. We recognise the need for openness and transparency by public authorities but in this instance the public interest in ensuring that TfL is able to obtain the best value for public money outweighs the general public interest in increasing transparency of our processes.

  • Any linkage with ULEZ cameras?

We can advise that the agreement of interest is not specifically a ULEZ contract. However, there may be requirements that arise during the contract duration which are ULEZ related and may utilise this contract.
