Possible Hythe Road London Overground station, Old Oak Common

Please be kind enough to provide all reasonable records regarding the proposed Hythe Road London Overground station, but LIMITED TO analysis, comparisons, and decisions regarding either providing a TWO-platform station there, or providing a THREE-platform station (the latter is the current intention). This request is focused on that particular issue only. It EXCLUDES all other matters regarding this station (no doubt you have a great deal of other material). Nevertheless, this request INCLUDES all related material, such as whether and how nearby Willesden Junction (high-level) station could handle all the necessary trains, if only a TWO-platform station were to be built.

Thank you for your email received by us on 13 October and your subsequent email clarifying your request received on 20 October 2017 asking for information on the proposed Hythe Road London Overground station at Old Oak Common.

Please note that in accordance with TfL’s obligations under the Data Protection Act 1998 (DPA) some personal data has been withheld, as required by section 40(2) of the FOI Act. This is because disclosure of this personal data would be a breach of the DPA, specifically the first principle of the DPA which requires all processing of personal data to be fair and lawful. It would not be fair to disclose this personal information when the individuals have no expectation it would be disclosed and TfL has not satisfied one of the conditions of Schedule 2 of the Data Protection Act which would make the processing ‘fair’.

In accordance with the FOI Act, we are not obliged to supply some of the information as it is subject to a statutory exemption to the right of access to information under section 43(2). In this instance the section 43(2) exemption has been applied to the detailed costing information contained within the Minutes of the Operations Workshop 1 and 2, as it would prejudice our commercial interests and it is likely that to disclose these would adversely impact on our ongoing negotiations with third parties around the funding options for the new Overground stations and associated infrastructure. This relates to any capital or operating costs.

The use of this exemption is subject to an assessment of the public interest in relation to the disclosure of the information concerned. We recognize the need for openness and transparency by public authorities, particularly where the expenditure of public money is concerned, but in this instance the public interest in ensuring that we are able to obtain the best value for public money outweighs the general public interest in increasing transparency of our processes.
