I wish to make an FOI request seeking emails between: Helen Chapman of TFLTPH and Mr Yaseen Aslam between the dates of 3rd January 2018 and the 30th January 2018

Thank you for your request received by Transport for London (TfL) on 26 September 2018 asking for emails between Helen Chapman of TFLTPH and Mr Yaseen Aslam between the dates of 3rd January 2018 and the 30th January 2018.

Your request has been considered in accordance with the requirements of the Freedom of Information Act and our information access policy. I can confirm that we hold the information you require.

However we are not obliged to provide the information you have requested as it is subject to statutory exemptions to the right of access to information under sections 40(2) and 41 of the FOI Act.

In accordance with TfL’s obligations under Data Protection legislation we are not obliged to provide personal data, as required by section 40(2) of the FOI Act. This is because disclosure of this personal data would be a breach of the legislation, specifically the first principle which requires all processing of personal data to be fair and lawful. It would not be fair to disclose this personal information when the individuals have no expectation it would be disclosed and TfL has not satisfied one of the conditions which would make the processing ‘fair’.

In addition, the exemption set out in section 41 has been applied as the information you have requested was provided to us by a third party in confidence.  Since section 41 is an absolute exemption, it is not necessary to consider whether the public interest in maintaining the exemption outweighs the public interest in disclosing the information.
