We answered

TfL Ref: 1712-1718

Thank you for your request received by Transport for London (TfL) on 2 October 2017 asking for a list of compromise agreements for each financial year since 2010 broken down by MD, Director and Payband 5 and Payband 4, along with the costs to TfL.

Your request has been considered in accordance with the requirements of the Freedom of Information Act and our information access policy. I can confirm that we hold the information you require.

Please note that in accordance with TfL’s obligations under the Data Protection Act 1998 (DPA) we are withholding this personal data as required by section 40(2) of the FOI Act. This is because disclosure of this personal data would be a breach of the DPA, specifically the first principle of the DPA which requires all processing of personal data to be fair and lawful. It would not be fair to disclose this personal information when the individuals have no expectation it would be disclosed and TfL has not satisfied one of the conditions of Schedule 2 of the Data Protection Act which would make the processing ‘fair’.  In this instance the exemption has been applied as, due to relatively low numbers, disclosure of the information you have requested in this format will allow for the identification of some people who have left TfL under a Compromise Agreement and would, in some instances, also allow people to establish how much they received.

Please see the attached information sheet for details of your right to appeal.

Yours sincerely
