FOI request detail

Bromley Road - highway dimensions

Request ID: FOI-1711-1920
Date published: 01 October 2019

You asked

Follow-up from 1277-1920: Thank you for your email with the links to the Property Asset Register as well as the attached GLA Roads Designation. Whilst these are interesting, they are however too crude for the requested purpose of obtaining 'accurate records of the whole highway dimensions' of Bromley Road (between the stated junctions with it and Callander Rd & Orford Rd). [a] Could you kindly make further enquiries to determine where accurate information is held? Could you also inform me where TfL engineers/planners will get their information from when carrying out future works? For example, it is currently proposed to alter the Bromley Road with key route cycle lanes. [b] The next part of my reframed request was for copies of any legal correspondence held by the TfL Legal Department. But this only concerns properties between (odd numbers) 169-265 Bromley Rd. Bearing in mind that TfL has only been responsible for red routes for just under 20 years, it is difficult to envisage that significant documentation would have accumulated. Could you kindly let me know on what basis s12 is thought to be applicable - as it would appear that there is a likely misunderstanding here, bearing in mind that I was only asking for information connected to the legal department and this was a narrowed request? [c] Soon after sending my email which contained reference to the legal responsibility with respect to illegal footway crossing enforcement - I discovered the correct answer and immediately emailed your department stating that that part was withdrawn. However, you make no reference to the email. Could you kindly locate and confirm that you have read it. Thank you for your help.

In reference to why the following part of your request was refused under section 12 of the FOI Act ‘Kindly request copies of any correspondence that might possibly exist and is held between the landowners (as referred to in 1.(iii) & (iv) above) and the TfL legal department’ in regards to 169-265 Bromley Rd, as mentioned previously, the cost-limit was applied given the considerable volume of records that we would need to locate and review to determine whether this information is held, which would then need to be collated for the purposes of your request. This information is not centrally located nor do the street numbers bear any reflection on the amount of documentation that would need to be scrutinised and suitably formatted to fulfil your previous request.
Unfortunately, aside from your other FOI Request (reference 1916-1920), we have not been able to locate the subsequent email mentioned in your correspondence.
If this is not the information you are looking for, or if you are unable to access it for any reason, please do not hesitate to contact me.
