Information relating to the August 2018 submission to the Broxbourne Local Plan Examination – Cheshunt Lakeside & Windmill Lane crossings

You asked

This FOI request relates to the Submission made in August 2018 by Crossrail 2 to the Broxbourne Local Plan Examination available at: https://www.broxbourne.gov.uk/resident-planning-and-building-planning-policy/written-statements-matters-6-11 . Please provide the following information: 1) Any correspondence and/or related information (including but not limited to letters, emails, reports, analyses etc) provided to or with the Lee Valley Regional Park Authority concerning the matters raised in the Submission. Particularly but not limited to: (i) The location of a new rail crossing at Windmill Lane, or from Cadmore Lane, or at any location between these two roads (Appendix 1: Northern Option Area of Search); or (ii) To the south of Windmill Lane / Cheshunt Station (Appendix 1: Southern Alignment Option Area of Search); 2) Any reports, surveys, analyses and assessments or similar documents or communications by or commissioned by or otherwise obtained by Crossrail 2 concerning the physical, environmental and other impacts of (i) and (ii) above on the Lee Valley Regional Park and River Lee Country Park (a) during and (b) after the construction of each of the elements of the new crossing - including but not limited to: the rail crossing; the access roads east and west of the rail crossing; and the road and associated footpaths and cycle ways, between (1) the rail crossing and (2) the area/s of the Lee Valley Youth Hostel, Herts Mariners Outdoor Centre and nearby residential properties; - including but not limited to the impact of site clearance ground works (including piling, foundations and ground stabilisation), construction machinery and traffic, road water runoff and the post-construction impact on, for example but not limited to: (i) The physical and amenity characteristics of the landscape; trees (including root protection areas) and bushes; biodiversity and ecology - including mammals, birds, amphibians and fish; ground and river plants; insects and other invertebrate species and their habitats; (ii) Hydrological impacts including but not limited to: groundwater, drainage, river flows and fluvial flood risks, and reservoir flood risks; including the effects of storm surges and climate change; (iii) The special riparian character of the Lee Valley (including as a RAMSAR site); (iv) Adjacent and nearby areas of the Lee Valley Regional Park designated as Sites of Special Scientific Interest (SSSIs) and as a Special Protection Area (SPA). (3) Any correspondence or related information (including but not limited to letters, emails, reports, analyses etc) concerning hydrological and environmental impacts (for example, those mentioned in (2) (i) to (iv)) with: Broxbourne Borough Council; Hertfordshire County Council; the Department for Environment, Food and Rural Affairs (DEFRA); the Environment Agency; and other statutory agencies and government bodies.

Thank you for your clarification emails received by Transport for London (TfL) on 4 October 2018 asking for information about Crossrail 2.

Your request has been considered in accordance with the requirements of the Environmental Information Regulations and TfL’s information access policy. I can confirm TfL does hold the information you require.

However, given the extent of the information you are looking for, we are applying Regulation 12(4)(b) as we believe that the request is ‘manifestly unreasonable’ because providing the information you have requested would impose unreasonable costs on us and require an unreasonable diversion of resources.

You have requested 3 years of correspondence and 5 years of data, correspondence, reports and analyses and a variety of subjects. To answer your current request would take an excessive amount of staff time and resources to locate, extract and collate.

Information relevant to your request is held by numerous people within TfL and Crossrail 2, in both electronic and paper files, and in a number of different places, all of which would have to be manually searched, to some extent at least, to answer your request.

The use of this exception is subject to a public interest test, which requires us to consider whether the public interest in applying the exception outweighs the public interest in disclosure. We recognise that the release of information would promote accountability and transparency in public services and also help address your particular concerns about this issue. However, the time it would take to provide the information you have requested would divert a disproportionate amount of our resources from its core functions and on balance we consider that the public interest currently favours the use of the exception.

We will consider your request again, if you are able to narrow its scope so that we can more easily locate, retrieve and extract the information you are seeking. If you have specific questions that you would like addressed we will be happy to consider those as this is less likely to raise concerns about the amount of resource required than a request that asks for ‘all emails’ on any given subject.
