You asked

Any and all statistical information (and related documentation) covering 1st January 2012 to the present indicating (1) the total amounts spent on litigation by TfL Taxi & Private Hire, (2) what activity classification (i.e. compliance, enforcement, etc) such litigation is given by TfL Taxi & Private Hire and (3) how those litigation costs are budgeted by TfL Taxi & Private Hire (i.e. licence fees, other TfL budgets, etc).

Thank you for your request received by Transport for London (TfL) on 19 September 2017 asking for information about litigation.

Your request has been considered in accordance with the requirements of the Freedom of Information Act and our information access policy. I can confirm we do hold the information you require.

However, to provide the information you have requested would exceed the ‘appropriate limit’ of £450 set by the Freedom of Information (Appropriate Limit and Fees) Regulations 2004.

Under section 12 of the FOI Act, we are not obliged to comply with a request if we estimate that the cost of determining whether we hold the information, locating and retrieving it and extracting it from other information would exceed the appropriate limit. This is calculated at £25 per hour for every hour spent on the activities described.

Expenditure on litigation is not separated from other external legal expenditure and so we are unable to directly report on these figures. Therefore, the only way to answer your request would be to manually locate and review our records across almost six years and then determine anything that was within the scope of your request and collate the information accordingly.

This, in itself, would be a significant task to undertake but you have also asked for “related documentation” which would further increase the workload required to process your request. To manually locate, extract and collate all of the relevant information caught by such a wide ranging request would considerably exceed the cost limit.

To help bring the cost of responding to your request within the £450 limit, you may wish to consider narrowing its scope so that we can more easily locate, retrieve and extract the information you are seeking. For example, by focusing on one particular aspect of the subject matter or for a narrowed period of time.
