Thank you for your request received by Transport for London (TfL) on 5 September 2018 asking for information regarding licensed private hire drivers and vehicles.

Your request has been considered under the requirements of the Freedom of Information Act 2000 and our information access policy. I can confirm that we do hold the information you require.

Data relating to individual licences is live and changes throughout the day; the data in the attached spreadsheets represents a snapshot of licensed private hire drivers as of 16 September 2018 and licensed private hire vehicles as of 20 August 2018.

We have not provided private hire driver contact details in accordance with our obligations under Data Protection legislation as required by section 40(2) of the FOI Act. This is because disclosure of this personal data would be a breach of the legislation, specifically the first principle which requires all processing of personal data to be fair and lawful. It would not be fair to disclose this personal information when the individuals have no expectation it would be disclosed and TfL has not satisfied one of the conditions which would make the processing ‘fair’.

Additionally, we have not provided private hire vehicle ownership information as it is subject to a statutory exemption to the right of access to information under section 43(2) of the FOI Act. In this instance section 43(2) exemption has been applied as disclosure would be likely to prejudice the commercial interests of private hire vehicle owners or operators as the information would provide competitors with an insight into the size of private hire operators and fleet owners, thereby undermining their position in the competitive market place.

The use of this exemption is subject to an assessment of the public interest in relation to the disclosure of the information concerned. We recognise the need for openness and transparency by public authorities, but in this instance feel that the balance lies in favour of withholding the information to ensure that private hire operators and fleet owners can continue to be able to operate effectively without being placed at a commercial disadvantage.
