You asked

Dear Sirs I am writing to make a request for all the information to which I am entitled under the Freedom of Information Act 2000. I cannot find this information on your website or at all. Please send me the following: 1. Bus Drivers Rule book (not the Big Red Book issued by Transport for London) 2. Bus Safety data release for 2013 (I see that your website has current Bus Safety data release to 2017 that includes 2015 onwards but not before and for 2013). 3. The ‘In the zone’ dvd which is training for bus drivers. 4. The contractual agreement between London Bus Services Limited and Arriva or Arriva London North Limited for bus route 141. (Route 141 was retained by Arriva London with a new contract commencing on 12 January 2013).

We answered

Thank you for your email received by us on 19 September 2017 asking for information about London Buses.

Your request has been considered in accordance with the requirements of the Freedom of Information Act and our information access policy. I can confirm that we hold some of the information you require. You asked for:

1.Bus Drivers Rule book (not the Big Red Book issued by Transport for London)

We do not hold this information as each bus operating company provides staff with their own rules of conduct to supplement the Big Red Book training manual for staff. If you would like to contact the operators directly their details can be found via the following link to our website: https://tfl.gov.uk/modes/buses/who-runs-your-bus?intcmp=44680 Please note that private companies are not obliged to respond under the Freedom of Information Act legislation.

2. Bus Safety data release for 2013 (I see that your website has current Bus Safety data release to 2017 that includes 2015 onwards but not before and for 2013).

Please see the attached spreadsheet; as the reporting system used for the data published online in 2013 changed in 2014, the categories subsequently used do vary.

3. The ‘In the zone’ dvd which is training for bus drivers.

A copy of this DVD is on its way to you.

Please note that the _____ clips referred to in the presentation on the DVD will be withheld under section 40(2) and 41of the FOI Act.

Section 40(2) has been applied as disclosure of this personal data would be a breach of the DPA, specifically the first principle of the DPA which requires all processing of personal data to be fair and lawful. It would not be fair to disclose the personal information contained in the clips when the individuals have no expectation it would be disclosed and TfL has not satisfied one of the conditions of Schedule 2 of the Data Protection Act which would make the processing ‘fair’.

Section 41 has been applied as the films were made under an explicit understanding that they would only be used for training purposes and not shared with a wider audience.

Both of these exemptions are absolute exemptions, therefore we have not gone on to consider the balance of the public interest. However, even if section 41 did not confer absolute exemption, there would be no special public interest in disclosure of this information that would justify a breach
