Our ref: FOI-1389-2021/GH

Thank you for your request received by Transport for London (TfL) on 21 October 2020 asking for information about claim processed for TfL by Gallagher Bassett.

Your request has been considered under the requirements of the Freedom of Information Act 2000 and our information access policy. I can confirm that we do hold the information you require.

  1. How many claims were processed? – you have clarified you are asking for the number of claims received

For the 2019/20 financial year, there were 317 claims set up.

(ii) How much was paid to the company?

We are not obliged to provide you with the fees paid as this information is subject to a statutory exemption to the right of access to information under section 43(2). In this instance the section 43(2) exemption has been applied as disclosure would, or would be likely to prejudice our commercial interests, as well as those of Gallagher Bassett. Disclosure of the price TfL currently pays could hinder the ability of Gallagher Bassett to competitively tender for similar contracts in the future as well as hinder TfL’s ability to negotiate the best value for money for similar services in the future.

The use of this exemption is subject to an assessment of the public interest in relation to the disclosure of the information concerned. We recognise the need for openness and transparency by public authorities, particularly where the expenditure of public money is concerned, but in this instance the public interest in ensuring that we are able to obtain the best value for public money outweighs the general public interest in increasing transparency of our processes.

(iii) How many claims were upheld?

11 claims were upheld/paid in 2019/2020 financial year (regardless of when they were received)

(iv) How much was paid in compensation.

For claims where a payment was made during the 2019/2020 financial year for compensation, irrespective of the date of accident or the date the claim was received, a sum of £213,052.86 has been paid.

If this is not the information you are looking for please do not hesitate to contact me.
