Thank you for your requests received by Transport for London (TfL) on 10 August 2022 asking for information about Private Hire Complaints & Licence Investigations
Your request has been considered under the requirements of the Freedom of Information Act 2000 and our information access policy. I can confirm that we do hold some of the information you require.
Please can you explain TfL's process following receipt of a PHV/105 form? This information is published on our website. The process is set out in the Taxi and Private Hire Driver Policy document – please see 4.15 and 4.16. Do all PHV/105 forms received result in a letter to the driver requesting written response to the allegations? This information is also available via the above link. . Please can you inform me of the number of licence revocations per year since 2017/18? To provide the information you have requested would exceed the ‘appropriate limit’ of £450 set by the Freedom of Information (Appropriate Limit and Fees) Regulations 2004.
Under section 12 of the FOI Act, we are not obliged to comply with requests if we estimate that the cost of determining whether we hold the information, locating and retrieving it and extracting it from other information would exceed the appropriate limit. In this instance, we estimate that the time required to answer this question would exceed 18 hours which, at £25 per hour (the rate stipulated by the Regulations), exceeds the ‘appropriate limit’.
To provide this information we would need to examine individual driver records – we do not keep a running / annual total. Manually checking each driver record would take an excessive amount of time.
How many revocations were overturned on receipt of written responses per year since 2017/18? To answer this question we would also need to manually look at driver records. This would also take an excessive amount of time, and would exceed the cost limit as explained above.
How many licence revocations have been appealed to the magistrates court since 2017/18? Information not held by TfL – it is held by the judiciary.
