I was just wondering if you could tell me, out of the total number of PCNs issued by NCP Parking for the last 3 years at Newbury Park station car parks, how many have gone to court under the railway bylaws? Is it correct that TFL have to take the driver to court and not NCP? What is TFL’s general stance on the matter of pursuing unpaid PCNs to court?

Thank you for your request received by Transport for London (TfL) on 22 July 2018 asking for information about the total number of PCNs issued by NCP Parking for the last 3 years at Newbury Park station car park.

Your request has been considered in accordance with the requirements of the Freedom of Information Act and our information access policy. I can confirm that we hold the information you require. You asked: I was just wondering if you could tell me, out of the total number of PCNs issued by NCP Parking for the last 3 years at Newbury Park station car parks, how many have gone to court under the railway bylaws? Is it correct that TFL have to take the driver to court and not NCP? What is TFL’s general stance on the matter of pursuing unpaid PCNs to court?

The answer to your first question is none. This is because NCP do not carry out enforcement under the Railway Bylaws. Currently our Terms and Conditions and enforcement are based upon contract law and as such there is no requirement for TfL to take the driver to court in pursuance of unpaid Penalty charge Notices (PCNS).
