Hello, Please send me all post incident reports for the suspension of the Elizabeth Line on the 29/06 due to a swan on the track at Westbourne Park, additionally to this please send me all the real-time communications (i.e Microsoft Teams, WhatsApp groups) during the incident between MTR management, MTR frontline customer experience staff, RfLI incident response, and the Romford control centre, please also send any reports/documents compiled in real time during the incident and photos taken of the offending swan. Thank you for your request received by Transport for London (TfL) on 7 July 2023 asking for information about the swan on the Elizabeth Line track on 29 June 2023.

Your request has been considered in accordance with the requirements of the Freedom of Information Act and our information access policy.  I can confirm that we hold the information you require. You asked for:

all post incident reports for the suspension of the Elizabeth Line on the 29/06 due to a swan on the track at Westbourne Park, additionally to this please send me all the real-time communications (i.e Microsoft Teams, WhatsApp groups) during the incident between MTR management, MTR frontline customer experience staff, RfLI incident response, and the Romford control centre, please also send any reports/documents compiled in real time during the incident and photos taken of the offending swan.

Please see the attached zip file for copies of the following reports from our concessionaire MTREL, as well as Transport for London’s Rail for London team. The latter is the wholly-owned TfL subsidiary, which manages the central operating section of the Elizabeth line - this makes up most of the route used by Elizabeth line services that is not part of the Network Rail network. The Central Operating Section runs from Westbourne Park Junction in the West to Abbey Wood in the South East and Pudding Mill Lane Junction in the East, mainly in newly constructed tunnels.

Please also note that in accordance with TfL’s obligations under the General Data Protection Regulation (GDPR), some personal data and images have been removed from the reports attached, as required by section 40 of the FOI. This is because disclosure of this personal data would be a breach of the legislation, specifically the first principle of the GDPR, which requires all processing of personal data to be fair and lawful. It would not be fair to disclose this personal information when the individuals have no expectation it would be disclosed and TfL has not satisfied one of the conditions which would make the processing ‘fair’.
 
This exemption to the right of access to information is an absolute exemption and not subject to an assessment of whether the public interest favours use of the exemption.
