You asked

1. TfL's policy, specifically in relation to the application of the Congestion Charge, where this involves the movement of motorists into the Congestion Zone, and whose entry therein would not occur save for forced diversion. 2. The extent of TfL's current publicity to the general public concerning movement of motorists into the Congestion Zone, and whose entry therein would not occur save for forced diversion. 3. Whether if the response to (2) is that no such publicity exists, the basis for such a lack of publicity. 4. TfL's method for recording "official diversions" into the Congestion Zone - including any protocols pertaining to utility companies or other organisations whose works or activities may forcibly direct motorists into the Congestion Zone, and whose movements into the Congestion Zone would not otherwise occur. In responding to the above, please provide me with all copies of correspondence, including TfL guidance, memoranda, file notes, all other records of communication pertaining tothose questions.

Thank you for your request received by Transport for London (TfL) on 14 September 2020 asking for information about Congestion Charging.

Your request has been considered under the requirements of the Freedom of Information Act 2000 and our information access policy. I can confirm that we do hold the information you require.

I can confirm that we do hold the information you require. However, to provide the information you have requested would exceed the ‘appropriate limit’ of £450 set by the Freedom of Information (Appropriate Limit and Fees) Regulations 2004.

Under section 12 of the FOI Act, we are not obliged to comply with requests if we estimate that the cost of determining whether we hold the information, locating and retrieving it and extracting it from other information would exceed the appropriate limit. In this instance, we estimate that the time required to answer your request would exceed 18 hours which, at £25 per hour (the rate stipulated by the Regulations), exceeds the ‘appropriate limit’.

You asked for “all copies of correspondence, including TfL guidance, memoranda, file notes and all other records of communication pertaining to the questions” that you raised. Locating and compiling this information, over an unspecified time period would exceed the appropriate limit.

To help bring the cost of responding to your requests within the £450 limit, you may wish to consider refining your requests to concentrate on matters which are important to you.
