Red route penalty charges for local authority dustcarts

To whom it may concern: I would like to make a freedom of information request. My questions are as follows: 1) How many PCNs are issued to local authority dustcarts collecting commercial waste while on red routes for this calendar year and the previous three calendar years. 2) How many of these are successfully appealed. 3) Whether any exemptions exist for local authorities for collecting waste while on red routes. 4) How many tickets are issued to private waste collection companies while collecting waste on red routes for this year and the previous three calendar years. 5) How many of these are successfully appealed.

Thank you for your request received by us on 8 July 2019 asking for information about red route Penalty Charge Notices and local authority waste collection vehicles.

Your request has been considered in accordance with the requirements of the Freedom of Information Act and our information access policy. You asked:

1) How many PCNs are issued to local authority dustcarts collecting commercial waste while on red routes for this calendar year and the previous three calendar years.

     I can advise that TfL may issue a Penalty Charge Notice (PCN) to any vehicle observed contravening a traffic restriction on the red route network.

When we record a contravention, we do not record the type of vehicle committing the contravention, therefore we do not hold information on the number of PCNs we have issued to waste collection vehicles.

1) How many of these are successfully appealed.

As mentioned in our response to Question One, when recording the contravention we do not record the vehicle type and therefore do not hold this information.

2) Whether any exemptions exist for local authorities for collecting waste while on red routes.

We manually operate the network of CCTV cameras used to ensure road users comply with London’s traffic laws. As the Highway Authority with the responsibility for the performance of the red route network, we place a very high priority on achieving full compliance with the restrictions and expect every road user to plan and operate their road use fully within the law at all times. Should we observe a waste collection vehicle that has stopped where prohibited but while performing their day to day operations, a common sense approach will be taken and a PCN will not be issued.

However, we would always issue a PCN to any vehicle observed that has stopped in a yellow box junction, performing a banned manoeuvre or causing a dangerous obstruction to other road users.

3) How many tickets are issued to private waste collection companies while collecting waste on red routes for this year and the previous three calendar years.

4) How many of these are successfully appealed.
