You asked

Follow-on from FOI-3870-1920: Having studied the data you published, I can see that a lot of data that did not need to be redacted has been redacted. Once the data is anonymised all, if not most of the columns in the Excel spreadsheet can be made public. I particularly want the information reacting to disability to be supplied please. I also do not see how the starting postcode for their journey (if no house number or name is included in the data) could not be included.

Thank you for your request received on 31 August 2020 asking for information about the consultation regarding the Cockfosters car park station development.

Your request has been considered in accordance with the requirements of the Freedom of Information (FOI) Act and our information access policy.  We do hold the information you require.

As previously stated, in accordance with TfL’s obligations under Data Protection legislation, the information requested has been withheld as required by section 40(2) of the FOI Act. The application of this exemption is subject to the ‘fairness test’ where consideration should be taken on whether there is a fair and reasonable expectation that the information would be disclosed. The surveys provide detail of the movement of individuals, as well as information on the person’s age, whether they have a disability, and if they are a Blue Badge holder. We do not think it would be fair to disclose this information as there is no expectation from the individuals that this information would be placed into the public domain and there would be a very real risk that individuals could potentially be identified from the information.

In addition, whilst we could provide the first half of the postcodes, in order to anonymise this data we would need to provide them in a way in which they would not align with the responses to avoid the risk of individuals being identifiable and therefore this would provide little or no value to any further understanding the responses.

This exemption to the right of access to information is an absolute exemption and not subject to an assessment of whether the public interest favours use of the exemption.
