TfL Ref: FOI-0977-1920
Thank you for your request received by Transport for London (TfL) on 3rd July 2019 asking for information about the use of TfL tickets.
Your request will be processed in accordance with the requirements of the Freedom of Information Act and our information access policy.
Specifically you asked:
“Is it against your bylaws or the law for me as an individual to give away my ticket which I purchased to another person whom I met at the train station for them to use? If so what are the legal ramifications to me in giving away my ticket?”.
The Public Service Vehicles Regulations 1990 include the following section:
“The conduct of passengers:
7.—(1) No passenger on a vehicle being used for the carriage of passengers at separate fares shall use any ticket which has–
(a)been altered or defaced;
(b)been issued for use by another person on terms that it is not transferable; or
(c)expired.”
Any person who transfers such a ticket could be prosecuted under section 44 of the Magistrates Court Act:
“Did aid, abet, counsel or procure (name) to commit a summary offence, namely an offence against Regulation7(1)(b) of the Public Service Vehicle Regulations 1990, by transferring a ticket which had been issued to you bearing an indication that it was not transferable. Contrary to Section 44 of the Magistrates' Court Act 1980 and Regulation7(1)(b) of the Public Service Vehicle (conduct of Drivers, Inspectors, Conductors & Passengers) Regulations 1990 SI No. 1020 and contrary to Section 25(3) of the Public Passenger Vehicles Act 1981.”
