I would be most grateful if you would provide me, under the Freedom of Information Act, details in respect to the contract below. Confidential Waste The details I require are: • Has confidential waste being procured via tender or framework or another means? • If a framework, could you confirm the name of the framework please? • Actual contract values of each framework/contract (& any sub lots) • Start date & duration of contract • Is there an extension clause in the framework(s)/contract(s) and, if so, the duration of the extension? • Has a decision been made yet on whether the framework(s)/contract(s) are being either extended or renewed? • Who is the procurement officer responsible for this contract and could you provide their email address and phone number please? Thank you for your request received by Transport for London (TfL) on 10 August 2021 asking for information about confidential waste contracts.

Your request has been considered under the requirements of the Freedom of Information Act 2000 and our information access policy. I can confirm that we do hold the information you require.
 
  • Has confidential waste being procured via tender or framework or another means?
Confidential waste collection service is included in the Transport for London Waste Management Services Lot 1a (General Waste) contract. The contract was awarded to Bywaters (Leyton) Limited in November 2020 by following an OJEU compliant competitive tendering process. Bywaters uses Shred Station Ltd (sub-contractor) for confidential waste collection service.
 
  • If a framework, could you confirm the name of the framework please?
It is not a framework agreement, it is a contract
 
  • Actual contract values of each framework/contract (& any sub lots)
The contract does not offer any guarantee for a minimum volume of the services or a minimum spend by TfL. Therefore, TfL will only pay for the services it uses during the contract term. Lot 1a was advertised with the other three lots (Lots 1b, 1c and Lot 2) and the estimated total value of all four lots was £30m
 
  • Start date & duration of contract
Start date: 16 November 2020
Duration: four (4) years
 
  • Is there an extension clause in the framework(s)/contract(s) and, if so, the duration of the extension?
Yes, an option to extend for an additional three (3) years in 12-month increments.
 
  • Has a decision been made yet on whether the framework(s)/contract(s) are being either extended or renewed?
The expiry date of the initial term of the contract with Bywaters is 15 November 2024. No decision has been made yet on whether the contract will be extended after the expiry date.
 
  • Who is the procurement officer responsible for this contract and could you provide their email address and phone number please?
  • Who is the senior officer (outside of procurement) responsible for this contract and could you provide their email address and phone number please?
Personal information such as email addresses and phone numbers are exempt under section 40 of the FOI Act. This is because disclosure of this personal data would be a breach of the legislation, specifically the first principle which requires all processing of personal data to be fair and lawful. It would not be fair to disclose this personal information when the individuals have no expectation it would be disclosed and TfL has not satisfied one of the conditions which would make the processing ‘fair’.
 
  • Who is the current supplier?
Bywaters (Leyton) Limited (Company Registration Number 00505212) is the main supplier for Waste Management Services Lot 1a (General Waste). Confidential waste collection service is part of lot 1a and Bywaters use Shred Station Ltd  (subcontractor) to provide the service.  Shred Station is a limited company registered in England and Wales, No: 6359628

Bywaters (main supplier) uses Shred Station Ltd (subcontractor) to provide the service.
