I would like to know how many people were issued with Road User Penalty Charge Notices (both ULEZ and Congestion Charge) in Great Cumberland Place, Marylebone, on the 2nd, 3rd, 4th and 5th April 2021. I would like to know how many of these PCNs were paid, and how many were successfully contested. I would also like to know how the above figures compare to the average daily number of PCNs issued and contested at the same location. You will be aware that on those days a diversionary route was in place via Great Cumberland Place, as a result of road closure due to crane works on Edgware Road, just to the north of Marble Arch.

Thank you for your request of 6th August 2021 asking for information about Penalty Charge Notices.

Your request has been considered in accordance with the requirements of the Freedom of Information Act and our information access policy. 

I can confirm that we hold the information you require. Your questions are answered in turn below:
Question 1: I would like to know how many people were issued with Road User Penalty Charge Notices (both ULEZ and Congestion Charge) in Great Cumberland Place, Marylebone, on the 2nd, 3rd, 4th and 5th April 2021. I would like to know how many of these PCNs were paid, and how many were successfully contested.
Due to safety concerns related to crane works, the Edgware Road Southbound between Marylebone Road and Marble Arch was closed to vehicular traffic from 22:00 hrs on 2 April 2021 until 05:00 on 5 April 2021. A signed diversion was in place diverting traffic along two alternative routes within the Congestion Charging and ULEZ zones. Drivers who did not follow the signed diversion routes risked incurring a Penalty Charge Notice (PCN). As explained below, any driver who believes a PCN has been issued incorrectly has the legal right to challenge the PCN.

Our cameras may capture a vehicle multiple times on its journey through the zone, however we only retain the images from one camera site for the purposes of issuing a PCN. Please see below for PCNs issued using images from our cameras in Great Cumberland Place. Please note however that, while the ULEZ operates 24 hours a day, the Congestion Charge (CC) operates only between 7am-10pm, therefore the CC PCNs issued on 2 April and 5 April were not issued while the closure was in place.

In order to challenge a PCN, the recipient must first submit a representation to us. If the representation is accepted the PCN is cancelled. If we reject the representation there is a further right of appeal to an Independent Adjudicator at the London Tribunals. Of the 488 PCNs issued over these four days, we have received 172 representations of which 33 were accepted, 120 were rejected and 19 remain open. To date, we have not been notified of any appeals to the Adjudicator. 107 of the PCNs have been paid.
Question 2: I would also like to know how the above figures compare to the average daily number of PCNs issued and contested at the same location. You will be aware that on those days a diversionary route was in place via Great Cumberland Place, as a result of road closure due to crane works on Edgware Road, just to the north of Marble Arch.
Please see below for the daily average number of PCNs issued using images from our cameras in Great Cumberland Place during the whole of March 2021, and the daily average number of representations made. There were no appeals lodged.
