To Whom It May Concern, I have recently discovered a Transport for London (TfL) document, dated 8 February 2011, which seeks to provide an update on the progress of Oyster pay as you go (PAYG) on National Rail (Agenda Item 8; Transport for London, Rail and Underground Panel; Subject: Oyster on National Rail - progress update; Date: 8 February 2011). This document refers an agreement between TfL and Train Operating Companies, signed on 16 October 2009, allowing Oyster pay as you go to be installed at all National Rail stations in London (Oyster PAYG Agreement). Please, would you provide me with all versions of the Oyster PAYG Agreement. Please, could you clarify whether there is a similar agreement covering ‘Contactless PAYG’. If so, please would you provide me with the all versions of this agreement as well. I look forward to hearing from you.

Thank you for your request received by Transport for London (TfL) on 3 July 2019 asking for information about Oyster pay as you go (PAYG) on National Rail.

Your request has been considered under the requirements of the Freedom of Information Act 2000 and our information access policy. I can confirm that we do hold the information you require.

Please find attached a copy of the PAYG Agreement (for Oyster) and a copy of the CPAY Agreement, which is for Contactless. These are the current and only versions of these agreements.

Specific pricing information has been redacted from these documents as this information is subject to a statutory exemption to the right of access to information under section 43(2). In this instance the section 43(2) exemption has been applied as disclosure would, or would be likely to prejudice our commercial interests.

The use of this exemption is subject to an assessment of the public interest in relation to the disclosure of the information concerned. We recognise the need for openness and transparency by public authorities, particularly where the expenditure of public money is concerned, but in this instance the public interest in ensuring that we are able to obtain the best value for public money outweighs the general public interest in increasing transparency of our processes.
