You asked

1) Can you please tell me how many formal Bullying and Harrassment cases have been raised in TfL Corporate since the start of 2016? 2) How many of these started with a formal interview with the complainant which took place after the complainant had resigned from TfL? 3) What rights are given to witnesses in Bullying and Harrassment complaints? 4) Are witnesses able to chase up the progress of the complaint? 5) Are witnesses able to know the outcome of the complaint? 6) Can the complainant chase up the progress of the complaint after they have left TfL?

Thank you for your email received by us on 20 July 2017 asking for information about formal bullying and harassment cases.

Your request has been considered in accordance with the requirements of the Freedom of Information Act and our information access policy.  I can confirm that we hold some of the information you require.  You asked:

1) Can you please tell me how many formal Bullying and Harassment cases have been raised in TfL Corporate since the start of 2016? :

2) How many of these started with a formal interview with the complainant which took place after the complainant had resigned from TfL? :
This information is not held in a reportable format and would need to be extracted through a review of the individual case records held in relation to each Bullying and Harassment case, which would then need to be cross referenced with the employment history information held about each employee. It is not clear from your request whether you are seeking information about employees who have given notice of their intention to resign at the time of the formal interview, or if the request is limited to those employees who have ceased to be employed by TfL at the time the interview took place. Could you also confirm whether you also wish us to search for instances where the employee has resigned from the role where the alleged incident(s) took place, but at the time of interview were working in a different role at TfL?

Because this part of your request requires a manual search and cross-referencing of information it may exceed the ‘appropriate limit’ of £450 set by the Freedom of Information (Appropriate Limit and Fees) Regulations 2004.

Under section 12 of the FOI Act, we are not obliged to comply with a request if we estimate that the cost of determining whether we hold the information, locating and retrieving it and extracting it from other information would exceed the appropriate limit. This is calculated at £25 per hour for every hour spent on the activities described. Please note that the costs of answering similar requests received within a 60 working day period may be aggregated.
 
3) What rights are given to witnesses in Bullying and Harassment complaints? :
Witnesses in all TfL processes have the same rights as all employees. However, as the case being heard is not against them they are not afforded the right to be accompanied.

4) Are witnesses able to chase up the progress of the complaint? :
Yes

5) Are witnesses able to know the outcome of the complaint? :
No
 
6) Can the complainant chase up the progress of the complaint after they have left TfL? :
Yes
