Hello, I would like to make the following request under the Freedom of Information Act: From the last five financial years (2018/19, 2017/18 and 2016/17, 2015/16 and 2014/15): Can I have a breakdown of all compensation claims paid out by Transport for London for incidents at TfL-managed Tube, DLR, Overground and tram stations/stops? In the breakdown can I have it broken down by each compensation claim - The general category of the claim (eg. Public liability, employers liability, death in service) - The location where the incident happened (i.e. Charing Cross, Sandilands, Hackney Central) - Details of the compensation - Number of claims made - The amount paid - Any free text in your database regarding the incident May I please also have the data in an Excel spreadsheet format.

Thank you for your emails received by Transport for London (TfL) on 27 June and 6 July 2019.

Your request has been considered in accordance with the requirements of the Freedom of Information (FOI) Act and TfL’s information access policy.  I can confirm TfL holds some of the information you require. You asked:

From the last five financial years (2018/19, 2017/18 and 2016/17, 2015/16 and 2014/15):

 

Can I have a breakdown of all compensation claims paid out by Transport for London for incidents at TfL-managed Tube, DLR, Overground and tram stations/stops?

 

In the breakdown can I have it broken down by each compensation claim paid out by TfL.

 

 

- The general category of the claim (eg. Public liability, employers liability, death in service)

- The location where the incident happened (i.e. Charing Cross, Sandilands, Hackney Central)

- Details of the compensation

 

- Number of claims made

 

- The amount paid

 

- Any free text in your database regarding the incident

 

Insurance claims for DLR and London Overground stations are the responsibility of the respective service providers;  Keolis Amey Docklands and Arriva Rail, not TfL. Therefore we do not hold the information you have requested for these modes.

Unfortunately, to provide the requested claims information that occurred at London Underground stations or tram stops, for the required financial years,  would exceed the ‘appropriate limit’ of £450 set by the Freedom of Information (Appropriate Limit and Fees) Regulations 2004.

Under section 12 of the FOI Act, we are not obliged to comply with a request if we estimate that the cost of determining whether we hold the information, locating and retrieving it and extracting it from other information would exceed the appropriate limit. This is calculated at £25 per hour for every hour spent on the activities described.

We have estimated that it would considerably exceed the cost to provide a response to this part of your request. There are no specific codes that link a claim to a station or stop as you have requested. Whilst a claim may be recorded at a specific station, it may be that it occurred outside of the station, either on the pavement or on a train between stations, in which case the claim is recorded against the station that the incident was reported at. To pin point which claims are relevant to your request would require manual review of hundreds of claims and would exceed the cost limit.

We could provide you with general claims data however it may be that some of the claims made could have occurred outside of the station e.g. in a car park next to the station), or on a train/tram at the station, or between stations/stops. If this would be of interest to you please let me know.

However, please note it is very likely that in your revised request we would need to consider the application of section 43(2) – commercial interests to details of each compensation claim, station break down and amount paid in each compensation, as disclosure of this information would be considered commercially sensitive.

Please note that we will not be taking further action until we receive your revised request.
