I understand that Uber's Part 8 declaration and the JR by the United Trade Action Group has been rolled into one hearing in November 2021. Can you please tell me if all parties are meeting their own legal costs in Uber's Part 8 declaration? Can you please tell me if the United Trade Action Group's JR of TFL granting Kapten an operators licence is subject to its own legal costs? Can you please tell me should TFL be successful in defending this JR claim of Kapten brought by the United Trade Action Group will TFL be seeking legal costs from the United Trade Action Group or has a cost agreement been agreed?

Thank you for your request received on 2 August 2021 asking for information about the Kapten Judicial Review by the United Trade Action Group (UTAG).

Your request has been considered in accordance with the requirements of the Freedom of Information Act and our information access policy. I can confirm we hold some of the information you require. You asked:

Can you please tell me if all parties are meeting their own legal costs in Uber's Part 8 declaration?

Can you please tell me if the United Trade Action Group's JR of TFL granting Kapten an operators licence is subject to its own legal costs?

All parties have agreed to bear their own costs in the Part 8 claim.

Can you please tell me should TFL be successful in defending this JR claim of Kapten brought by the United Trade Action Group will TFL be seeking legal costs from the United Trade Action Group or has a cost agreement been agreed?

We do not hold this information. Costs are to be determined by the Court in the United Trade Action Group’s Judicial Review after the conclusion of the proceedings.
