Thank you for your request received by Transport for London (TfL) on 19 June 2023 asking for information about Personal Injury Claims.
Your request has been considered under the requirements of the Freedom of Information Act 2000 and our information access policy. I can confirm that we do hold the information you require.
What is the Compensation solicitor firm which has won the most cases against TFL for compensation for personal injuries
This information is not recorded on a searchable basis and would need a manual review of many files that have been closed over many years. We receive an average of 1,500 claims per year. Whilst not all claims are paid. This would still be a huge undertaking. Providing this information would therefore exceed the ‘appropriate limit’ of £450 set by the Freedom of Information (Appropriate Limit and Fees) Regulations 2004.
Under section 12 of the FOI Act, we are not obliged to comply with requests if we estimate that the cost of determining whether we hold the information, locating and retrieving it and extracting it from other information would exceed the appropriate limit. In this instance, we estimate that the time required to answer your request would exceed 18 hours which, at £25 per hour (the rate stipulated by the Regulations), exceeds the ‘appropriate limit’.
What is the average compensation claim for psychological trauma which occurred due to a personal injuries using TFL services
Claims for injury that also include an element of compensation for psychological trauma are settled on the basis of one compensation figure. A separate figure for individual elements of the injury claim are not specified or recorded.
