You asked

Treating this letter as a freedom of information request, please can you advise me who made that decision and what justification, if any, was given . In fact, I would like all possible information concerning this decision, including any discussions regarding its validity and whether there was any internal challenge . Also can you advise me whether letters were sent to those had left the organization, but were employed in other Directorates . Did which Directorate you worked in determine how you were treated in terms of the information you received, and if so, please explain the rationale for this different treatment for the same set of circumstances?

Thank you for your request received by us on 24 June 2019  asking for information about performance awards to former employees.

Your request has been considered in accordance with the requirements of the Freedom of Information Act and our information access policy.  I can confirm that we hold the information you require. You asked: ‘Please can you advise me who made that decision and what justification, if any, was given.  In fact, I would like all possible information concerning this decision, including any discussions regarding its validity and whether there was any internal challenge . Also can you advise me whether letters were sent to those had left the organization, but were employed in other Directorates.  Did which Directorate you worked in determine how you were treated in terms of the information you received, and if so, please explain the rationale for this different treatment for the same set of circumstances?

Please be aware that, under the FOI Act, we do not have to answer a request if it would require the creation of new information or the provision of a judgement, explanation, advice or opinion that was not already recorded at the time of the request. On this basis, we can only answer the part above in bold as a request under the FOI Act 2000.

Please find attached an email confirming that Ian Nunn the Finance Director at the time signed off the decision you have asked about.  Also attached is a second email, and although it refers to another individual, it makes clear that the decision not to pay bonuses to leavers was taken as previously advised.  A third email is also attached which I understand you have already received as part of our reply to your Subject Access Request. We do not hold any further information on this matter.

Please note that in accordance with TfL’s obligations under Data Protection legislation some personal data has been removed, as required by section 40(2) of the FOI Act. This is because disclosure of this personal data would be a breach of the legislation, specifically the first principle which requires all processing of personal data to be fair and lawful. It would not be fair to disclose this personal information when the individuals have no expectation it would be disclosed and TfL has not satisfied one of the conditions which would make the processing ‘fair’.
