You asked

Dear sir/Madam Iam a private hire driver and my vehicle allows to carry maximum of 4 passengers as stated on my vehicle licence. I understand that a child under 3 years old can sit on a lap on back seat. In many instances there are 4 adult passengers and a baby which makes it 5 passenger. My Question is if this is allowed? Or it has to be 3 passangers and a baby maximum? I hope to hear from you soon. Regards XXXX

Thank you for your request received by Transport for London (TfL) on 12 June 2024 asking for information about passenger capacity in private hire vehicles.

 

Your request has been considered under the requirements of the Freedom of Information Act 2000 and our information access policy. 

 

I can confirm that we do hold the information you require.

 

Government Best Practice Guidance states in relation to passenger carrying numbers: Given the implications for the safety of passengers, a practical solution would be for taxis and private hire vehicles to carry no more people than the number of seatbelts available, regardless of passenger age. 

 

The government website also provides advice on the transportation of children generally in vehicles, along with information specifically for taxis and private hire vehicles.
