Thank you for your email received by Transport for London (TfL) on 24 June 2019.

Your request has been considered in accordance with the requirements of the Freedom of Information Act and our information access policy.  I can confirm we do hold the information you require. You asked:

I'd like to find out how many Certificate of Conformity TfL has received by motorcycle owners in order to prove that the ULEZ charge is not a valid charge on their machine. I'd like to get this information to indicate the following please:

1. Breakdowns to show the Certificates received by TfL by manufacturer, model and year of manufacture.

2. Total Certificates of Conformity received for all vehicles to date (or last summary date)

Specific returns for the following makes and model by year:

a. Yamaha TDM900 (TDM 900)

b. Yamaha TDM850 (TDM 850)

c. Yamaha TRX

Our ULEZ compliance data is predominantly based on the vehicle information held by the DVLA. When this is incomplete, or when a vehicle is registered outside of the UK, we invite motorists to contact us and provide evidence to confirm their vehicle complies with the ULEZ emission standards. When we update a vehicle record to make it compliant with the ULEZ we do not record the make and model or the type of vehicle being updated.

As of 6 June 2019 we have updated 16,217 vehicle records as a result of motorists contacting us and providing information to confirm their vehicle is compliant with the ULEZ standards.

Unfortunately, to break it down to the level you require would exceed the ‘appropriate limit’ of £450 set by the Freedom of Information (Appropriate Limit and Fees) Regulations 2004. Under section 12 of the FOI Act, we are not obliged to comply with a request if we estimate that the cost of determining whether we hold the information, locating and retrieving it and extracting it from other information would exceed the appropriate limit. This is calculated at £25 per hour for every hour spent on the activities described.

In order to identify the make and model of the vehicles we would need to manually access each individual enquiry which led us to update the record. This would involve checking and verifying 16,217 records which would considerably exceed the cost limit.

To help bring the cost of responding to your request within the £450 limit, you may wish to consider narrowing its scope so that we can more easily locate, retrieve and extract the information you are seeking. If you want to refine your request or make a Freedom of Information Act request in future, please bear in mind that the Freedom of Information Act allows you to request recorded information held by Transport for London. You should identify the information that you want as clearly and concisely as you can, specifying the information you are looking for.

Please note that we will not be taking further action until we receive your revised request.
