You asked

I would like to be provided with information about the Taxi Hearing Procedure described in Appendix C on page 111, of the TfL, TPH Staff Manual (V12.1). In the sixth paragraph it states that the convention for the conduct of the hearing has been agreed by TfL and stood the test of time and a Judicial Review. Please provide me with details of the Review in question, including the date and case number.

Thank you for your request received on 22 June 2018 asking for information about Taxi Hearing Procedures.

Your request has been considered in accordance with the requirements of the Freedom of Information Act and our information access policy. I can confirm we do hold the information you require.

The statement in our Staff Manual is not in reference to a specific judicial review, or application for judicial review regarding our reconsideration hearing procedures in isolation. It refers to a number of applications for judicial review that have been made where our procedures have been tested and found not to have any irregularities in the way the hearings are conducted. A judgment of 18 November 1994 (CO/21/2194) before Justice MacPherson provides supportive statements in respect of our procedures, as does a judgment of 2 December 1992 (CO/1615/92) before Justice Auld. Both of these cases were heard at the Royal Courts of Justice.

To avoid confusion we will look to make this clearer in the next iteration of our Staff Manual.
