Thank you for your request received by Transport for London (TfL) on 12 June 2018 asking for information about Penalty Charge Notices (PCNs) for the T-Charge.

Your request has been processed in accordance with the requirements of the Freedom of Information Act and our information access policy. I can confirm we do not hold the information you requested. You asked:

I would like to know the number of successful appeals made from start of the T-charge 23rd Oct 2017 to the 1st June 2018 as a result of inaccurate data held by TFL as produced by the T-Charge Compliance Checker.

Our online T-Charge compliance checker primarily uses the year of a vehicle’s registration, as recorded by the DVLA to ascertain whether a vehicle is subject to the T-Charge.  The Euro 4 emissions standard applied to new passenger car approvals from January 2005. 

We issue PCNs when we have reason to believe a contravention occurred. Should a driver believe the PCN was issued incorrectly, they can challenge the PCN. All PCNs are subject to a statutory representations and appeals process and each challenge is considered on a case-by-case basis, including any mitigating circumstances. We have the discretion to cancel a PCN or refund all or part of a PCN payment at any time and for any reason, however this would not mean the PCN was issued incorrectly. If a representation is rejected, the driver is within their rights to appeal to an independent adjudicator. Should a driver pay a PCN and later have their representation accepted or appeal allowed, any payment will be refunded.

As every PCN is served in line with our statutory process, we do not hold requested the information.
