You asked

Dear Transport for London, I refer to Order GLA 2023 No. 0022 (A11, A126 AND A1203 GLA ROADS 20 MPH SPEED LIMITS) issued by Transport for London under Chairman Sadiq Khan. The Order was signed by Mark Griffiths, Performance & Planning Manager for Transport for London. This Order carries the full weight of law, equal to laws having undergone Parliamentary scrutiny, and the public will be prosecuted for alleged violations of it under the enforcement powers of the Met Police and Crown Prosecution Service. I note that Mark Griffiths is not listed as a Transport for London Board Member (1), for which Sadiq Khan is chair, or a TfL Chief Officer (2). The TfL Scheme of Delegation (3) states the following: The Board delegates to the Chief Operating Officer and, with that Chief Officer’s written consent, to each Officer responsible to that Chief Officer, the discharge of any of the following functions, except for functions reserved to the Board or delegated to other bodies or Postholders by Standing Orders or otherwise: b) any function of TfL relevant to the use of the highway, including but not limited to functions under: (ii) the Road Traffic Regulation Act 1984; I have two information requests: 1. Please confirm whether Mark Griffiths had legal capacity to sign order GLA 2023 NO. 0022 at the time of signature. 2. If he did, then please provide the signed written consent from the Chief Operating Officer granting Mark Griffiths legal capacity to sign and bind TfL to GLA 2023 NO. 0022.

Thank you for your request received by Transport for London (TfL) on 15 May 2024.

Your request has been considered in accordance with the requirements of the Environmental Information Regulations and our information access policy. I can confirm that we hold the information you require. You asked:  
I refer to Order GLA 2023 No. 0022 (A11, A126 AND A1203 GLA ROADS 20 MPH SPEED LIMITS) issued by Transport for London under Chairman Sadiq Khan. The Order was signed by Mark Griffiths, Performance & Planning Manager for Transport for London. I note that Mark Griffiths is not listed as a Transport for London Board Member (1), for which Sadiq Khan is chair, or a TfL Chief Officer (2).

I have two information requests:

1. Please confirm whether Mark Griffiths had legal capacity to sign order GLA 2023 NO. 0022 at the time of signature.
2. If he did, then please provide the signed written consent from the Chief Operating Officer granting Mark Griffiths legal capacity to sign and bind TfL to GLA 2023 NO. 0022.



Please find enclosed two written consents made under TfL’s Standing Orders which include reference the relevant officer role.  These consents provide for officers to discharge functions of TfL in respect of matters for which those officers have responsibility.

In accordance with our obligations under Data Protection legislation some personal data has been removed, as required by regulation 13 of the EIR. This is because disclosure of this personal data would be a breach of the legislation, specifically the first principle of Article 5 of the UK General Data Protection Regulation which requires all processing of personal data to be fair and lawful. It would not be fair to disclose this personal information when the individuals have no expectation it would be disclosed and TfL has not satisfied one of the conditions which would make the processing ‘fair’.
