You asked

Hello, please could you upload a copy of the full Sponsorship Agreement which covers the temporary renaming of Seven Sisters, Shepherds Bush and Waterloo stations in association with Fybogel. The full agreement with Nestle Waters was previously published when Canada Water was renamed Buxton Water (https://content.tfl.gov.uk/canada-water-renaming-sponsorship-agreement.pdf). This should provide full details of the benefits at each station, the use of the new name on roundels, dot matrix signs, maps etc., the start and end times of these renamings, the delivery logistics, and the costs. Many thanks in advance for your assistance.

TfL Ref: FOI-0419-2122

Thank you for your request of 29th May 2021 asking for a copy of the sponsorship agreement which covers the temporary renaming of Seven Sisters, Shepherds Bush and Waterloo stations in association with Fybogel.

Your request has been considered in accordance with the requirements of the Freedom of Information Act and our information access policy.

Specifically you asked:

Hello, please could you upload a copy of the full Sponsorship Agreement which covers the temporary renaming of Seven Sisters, Shepherds Bush and Waterloo stations in association with Fybogel.

The full agreement with Nestle Waters was previously published when Canada Water was renamed Buxton Water (https://content.tfl.gov.uk/canada-water-renaming-sponsorship-agreement.pdf).

I can confirm that we hold the information you require. However, the information is exempt from disclosure under section 22 of the Freedom of Information Act, which applies where information is due for future publication. The contract will be published on the TfL website in a matter of weeks, via the following link:

https://tfl.gov.uk/corporate/publications-and-reports/contracts

Section 22 is a qualified exemption, meaning we have to assess whether the overall balance of public interest lies in applying the exemption and withholding the information, or in releasing it in any case. We appreciate the need for openness and transparency in the operation of our business, and the fact that you have asked for the documents is in itself an argument in favour of release. However, it is also important that we are able to publish such material in accordance with already agreed internal schedules. Further, the guidance from the Information Commissioner on the use of this exemption states that:

“The closer to the date of publication, the more reasonable it is likely to be for the public authority to withhold the information until publication has taken place.

In this case, publication is expected in a relatively short amount of time, and therefore we believe it is reasonable and in the overall balance of public interest to withhold the information until that publication has taken place.

Notwithstanding the above, I can inform you that the agreement covered the following key details:

24 hour activation to promote the new Fybogel drink, installed on 27th May 2021 and removed on 28th May 2021, including:

3 x platform roundels at Shepherds Bush, changing them from ‘Shepherds Bush’ to ‘Shepherds Flush’;
3 x platform roundels at Waterloo changing them from ‘Waterloo’ to ‘Waterloo Roll’, and;
1 x platform roundel at Seven Sisters to ‘Seven Cisterns’.

Please see the attached information sheet for details of your right to appeal as well as information on copyright and what to do if you would like to re-use any of the information we have disclosed.

Yours sincerely,
