Thank you for your request which we received on 29 April 2024, asking for information about representations received against penalty charge notices (PCNs).

Your request has been considered in accordance with the requirements of the Freedom of Information Act and our information access policy.  I can confirm that we hold some of the information you require. You asked: 

 

  1. Total number of representations Accepted and rejected split by Month since December 2023

On receipt of a penalty a motorist has the right to challenge it by submitting a representation to us. If this is accepted the penalty is cancelled. If rejected the penalty remains open and a further right of appeal to an independent adjudicator at London Tribunals is granted. 

Since 1 December 2023, a total of 922,230 PCNs have been issued. In response we have received a total of 110,060 representations challenging these penalties. 74,070 of these have been accepted and 16,679 have been rejected. 19,311 remain open. Please note, these numbers will change as more representations are received and considered. These figures are correct as of 15 May 2024. The monthly breakdown is below.

It is also important to note that the acceptance of a representation does not indicate that the penalty was incorrectly issued. We do exercise discretion and consider mitigating circumstances when dealing with penalties. This can often result in a representation being accepted, even when the penalty has been correctly issued. For example, if a motorist pays for the wrong date of travel or wrong vehicle registration we may accept a representation even through the penalty has been correctly issued.  

  1. Number of complaints received against ULEZ charges

We do not record at this level of specificity. PCNs are disputed through the aforementioned representations and appeals procedures rather than through the complaint’s procedure. 

 

  1. Total amount of charges collected by TFL due to ULEZ

Since 1 December 2023 until 30 April 2024, 6,380,908 daily ULEZ charges have been paid totalling £79,761,350.

 

  1. How are these charges spent by TFL- Please provide split if possible

All income from ULEZ is reinvested into improving transport in London. 

 

  1. The average difference between date stated on formal notice of rejection and the date this letter is posted.

A Notice of Rejection (NoR) is issued by first class Royal Mail post on the date of issue detailed on the NoR. 

  1. Number of complaints about short notice between receipt of the notice of rejection and end of 14 day period to make the reduced penalty payment

We do not hold information on complaints made for this reason as they are not recorded at this level of specificity.
