Pursuant to the Freedom of Information Act 2000 and the Environmental Information Regulations 2004, we request the following information and documentation: 1. Copies of your tree policies within the period 2010 and 2021 or where to locate said policies if readily accessible in electronic format; 2. A copy of your tree maintenance works carried out to the London Plane trees under your ownership and control, located to the front of the above Property (T6 and T7 on the attached site plan), between 2010 and 2021, pertaining to but not restricted to recommended works, extent of works completed and inspections; 3. A copy of your risk analysis in respect of T6 and T7 London Plane trees, between 2010 and 2021, to include any maintenance regimes, if any, also carried out within this period; 4. Details of the information retained by and/or accessible to you in respect of the soil types in: 4.1 The St. Mildreds Road area 5. The number of tree related subsidence claims that have been brought against you within the SE12 postcode area and St Mildreds Road between 2010 and 2021. Thank you for your request received by Transport for London (TfL) on 18 May 2021.

Your request has been considered in accordance with the requirements of the Freedom of Information (FOI) Act and our information access policy.

Unfortunately, to provide the information you have requested would exceed the ‘appropriate limit’ of £450 set by the Freedom of Information (Appropriate Limit and Fees) Regulations 2004.

Under section 12 of the FOI Act, we are not obliged to comply with a request if we estimate that the cost of determining whether we hold the information, locating and retrieving it and extracting it from other information would exceed the appropriate limit. This is calculated at £25 per hour for every hour spent on the activities described.

We have located two tree related subsidence claims from St Mildreds Road within the 2010 to 2021 period. However, we have estimated that question 5 alone would considerably exceed the cost limit to provide a response to your current request. This is because in relation to the number of tree related subsidence claims within the SE12 post code area, we do not record the post code in the system. There are nearly 400 subsidence related claims, and someone would have to manually check all the corresponding documents to see if they were in the SE12 post code area and for the other data to be obtained. To further provide all the maintenance records you have requested would of course increase the processing time required to complete your request.

To help bring the cost of responding to your request within the £450 limit, you may wish to consider narrowing its scope so that we can more easily locate, retrieve and extract the information you are seeking. You might also consider limiting your request to a shorter period of time or geographical area.

However, if you are considering submitting a further request please think carefully about whether the request is essential at this current time, as answering FOI/EIR requests will require the use of limited resources and the attention of staff who could be supporting other essential activity. Where requests are made, please note that our response time may be impacted by the current situation.
