You asked

Dear Sir or Madam, I am writing to request information under the Freedom of Information Act 2000. Under the Act I am requesting the following: 1. Copies of any contracts currently held between ABM Industries (or any of its subsidiaries) and London Underground Limited (or Transport for London). 2. Procurement schedules for London Underground Limited or Transport for London running up until 2030. 3) Current details of contracts of staff covered in ABM contract mentioned in (1).

Thank you for your email received by us on 1 May 2019 asking for information about contract details with ABM Industries.

Your request has been considered in accordance with the requirements of the Freedom of Information (FOI) Act and our information access policy. I can confirm we do hold the information you require. You asked for:

1. Copies of any contracts currently held between ABM Industries (or any of its subsidiaries) and London Underground Limited (or Transport for London).

2. Procurement schedules for London Underground Limited or Transport for London running up until 2030.

We assume that you are referring to the ‘1FM Bundle 5 - Cleaning and Associated Services contract (TfL-00929)’, which along with the requested schedules are published via the following link to the Contract Finder’s website at: https://www.contractsfinder.service.gov.uk/Notice/20eeefc9-07d0-44ae-a70a-3b0aa5a12fa4

3) Current details of contracts of staff covered in ABM contract mentioned in (1).

In accordance with TfL’s obligations under Data Protection Legislation, we are not obliged to disclose individuals contracts of employment with ABM, as required by section 40(2) of the Freedom of Information Act. This is because disclosure of this personal data would be a breach of the legislation, specifically the first principle which requires all processing of personal data to be fair and lawful. It would not be fair to disclose this personal information when the individuals have no expectation it would be disclosed and TfL has not satisfied one of the conditions which would make the processing ‘fair’. This is an absolute exemption and therefore not subject to a public interest test.
