Thank you for your request which we received on 25 April 2024. You asked for all historical communication between TfL and a third party, relating to a fence at your property.
Your request has been considered in accordance with the requirements of the Freedom of Information Act and our information access policy.
Any communication between TfL and the third party concerned, constitutes the individual’s personal data. Therefore we are withholding the requested information under Section 40 of the Freedom of Information Act (FOI). Disclosure of this personal information could be a breach of the GDPR, specifically the first principle of the legislation which requires all processing of personal data to be fair and lawful. It would not be fair to disclose this information when the individual has no expectation it would be disclosed, and TfL has not satisfied one of the conditions which would make the processing ‘fair’.
This exemption to the right of access to information is an absolute exemption and not subject to an assessment of whether the public interest favours use of the exemption.
