You asked

Please be kind enough to supply all material from 1 October 2018 (such as emails and reports, and including attached email chains, even if earlier), to date, reasonably related to provision of West London Orbital line services (including for longer, non-London Overground trains) at or through a station at Brent Cross (now named Brent Cross West Thameslink or similar). That includes all possible considered options, including an entirely separate, second station for the West London Orbital nearby. (Please have special regard to all mentions of the length of any West London Orbital platforms when collecting such material, since that would mean a variety of rail services are being considered. Note also that these services reach Brent Cross via the Dudding Hill freight line across Ealing, Brent and Barnet, joining at Brent Cross, so some relevant material may refer to that.)

Thank you for your email received by Transport for London (TfL) on 26 April 2019.

Your request has been considered in accordance with the requirements of the Environmental Information Regulations and our information access policy.  I can confirm we do hold the information you require. You asked:

That includes all possible considered options, including an entirely separate, second station for the West London Orbital nearby.

You will note some email chains mention attached documents which aren’t included. That’s because the attachments are either not relevant to your request or contain information which is still ‘in draft’. The West London Orbital Business Case has been published now and is available on the TfL website at https://tfl.gov.uk/corporate/publications-and-reports/west-london-orbital

We are not obliged to provide information which is in draft or incomplete as it is subject to a statutory exception to the right of access to information under Regulation 12(4)(d). The exception provides that a public authority may refuse to disclose information that relates to material which is in the course of completion, to unfinished documents or to incomplete data.

This exception is subject to a public interest test, which requires us to assess whether the public interest in applying the exception outweighs the public interest in disclosure. In this instance, it is considered that the public interest favours the finalisation of the information, after all relevant factors and input from the consultation can be taken into account, rather than the disclosure of information which does not accurately reflect any amendments that might still be made.

Furthermore, in accordance with TfL’s obligations under the Data Protection legislation some personal data has been removed, as required by Regulation 13 of the Environmental Information Regulations. This is because disclosure of this personal data would be a breach of the legislation, specifically the first principle of the legislation, which requires all processing of personal data to be fair and lawful. It would not be fair to disclose this personal information when the individuals have no expectation it would be disclosed and TfL has not satisfied one of the conditions of Schedule 2 which would make the processing ‘fair’.
