Please can you provide a full copy of the new YUNEX contract awarded in 2023, along with a copy of the preceding contract with YUNEX and/or Siemens Mobility

Thank you for your request received by Transport for London (TfL) on 27 April 2023 asking for information about the Yunex contracts.

Your request has been considered in accordance with the requirements of the Freedom of Information Act and our information access policy.  I can confirm that we hold the information you require. You asked for:

a full copy of the new YUNEX contract awarded in 2023,

In accordance with the FOI Act, we are not obliged to supply the information you have requested for this part of your request as it is subject to a statutory exemption to the right of access to information, under Section 22 of the Act.

In this instance the exemption has been applied as the new contract you have requested is intended for future publication by mid-June 2023 on the Contract Finder here: https://www.gov.uk/contracts-finder. This exemption is subject to a public interest test, which requires us to assess whether the public interest in applying the exemption outweighs the public interest in disclosure. We consider that the public interest favours the publication of this information, in context and according to the pre-determined schedule, rather than in response to your request, to ensure the information is provided accurately and in an accessible manner.

Please refer to the attached zip file for this contract. Please note that some of the content is exempt from disclosure and has therefore been withheld in accordance with section 43(2) commercial interests, as disclosure of, for example, the service level agreement, fixed unit rates for equipment maintenance and schedule and rates, could give an insight into how the value of this agreement was reached and would be likely to prejudice our commercial interests, as well as Yunex (previously Siemens). Prejudice would be likely to occur if we were to seek similar services or Yunex (previously Siemens) were to compete for tendering opportunities in the future, as detailed knowledge of their commercial expertise would inevitably be prejudiced by disclosing a detailed breakdown of their competitive edge into the public domain.

The use of this exemption is subject to an assessment of the public interest in relation to the disclosure of the information concerned. We recognise the need for openness and transparency by public authorities but in this instance the public interest in ensuring that TfL is able to obtain the best value for the public purse outweighs the general public interest in increasing transparency of our processes.
