Thank you for your request received by Transport for London (TfL) on 29 April 2019 asking for information about Penalty Charge Notices (PCNs) issued for Congestion Charge violations at Upper Montague Street.

Your request has been considered under the requirements of the Freedom of Information Act 2000 and our information access policy. I can confirm that we do hold the information you require.

  1. How many PCNs have been issued for vehicles travelling south entering the CG at Gloucester Place since Gloucester Place became two-way?

3.  How many of these appeals have been upheld?

Baker Street and Gloucester Place formed a large one-way system running from Regent's Park to Oxford Street; we switched to two-way traffic on 24 February 2019.

Between 24 February 2019 and 31 May, we received 29 representations against the 4,127 PCNs we issued for non payment of the Congestion Charge to vehicles observed by our Automatic Number Plate Recognition cameras on Gloucester Place, W1H; this resulted in 17 PCNs being cancelled. 3 appeals were submitted to London Tribunals; these are all still being investigated.

4. Are there CG cameras facing north towards Marylebone Road in Upper Montague Street?

Yes.

5. Are there any signs or notices advising that when driving south down Gloucester Place, a right turn at Marylebone Junction is forbidden - apart from the “No right turn” sign at the junction itself?

Yes. There is an advanced warning sign location south of Dorset Square informing drivers of the no left or right turn into Marylebone Road with ULEZ and CC symbols indicating vehicles proceeding ahead may enter the zone.

6.Is failure to pay the Congestion Charge a civil or Criminal Act?

7.Is failure to pay a PCN for a congestion charge violation a criminal or civil act?

For questions 6 and 7, due to the decriminalised nature of the penalties we issue, issues surrounding the payment of PCNs do not infringe on your statutory rights, will not result in you receiving any County Court Judgements or affect your credit rating. A PCN should be regarded as a civil debt and not a fine. The Congestion Charge is a charge for a service and not a tax.
