I request a list of previous complaints and under freedom of information I request a list of replies to these complaints in order that I can take legal action. Additionally under freedom of information please supply information about exact amounts of the penalty money and emissions zone fees allocated to which clean air projects. Under freedom of information identity how much council money would be allocated to these projects which would not be these said fees and penalties and would be in line with other councils. Under FOI identity how all these fees are allocated and used.

Our Road User Charging Team has passed over your request of 9th April 2023 for me to answer.
Your request has been considered in accordance with the requirements of the Freedom of Information Act and our information access policy.
Specifically you asked:
“I request a list of previous complaints and under freedom of information I request a list of replies to these complaints in order that I can take legal action. Under FOI identity how all these fees are allocated and used.” Note that the first element of your request (about your previous complaints) will be addressed by our Road User Charging team directly as this information falls under the provisions of Data Protection law (as it relates directly to yourself) rather than the Freedom of Information Act.
In regard to your question about the spending of revenue generated from our Road User Charging schemes, and specifically, “emissions zone fees”, I am afraid that it is not possible to source this information within the costs limit for responding to FOI cases, as set out under section 12 of the Freedom of Information Act. Under section 12, TfL is not required to provide information if it would cost more than £450 to determine if that information is held, and to then locate, retrieve or extract it from elsewhere. This is calculated at a rate of £25 per hour, equivalent to 18 hours work. Note that the information you have requested would cover both the Low Emission Zone (LEZ), which came into effect in February 2008, and the Ultra Low Emission Zone (ULEZ), which began in April 2019. It is not possible to source the infromation requested over this timeframe within the costs limit. However, that said, note that the net proceeds raised from our Road User Charging schemes must be used for purposes that directly or indirectly facilitate the implementation or any policies or proposals set out in the Mayor’s Transport Strategy (see here: https://www.london.gov.uk/programmes-strategies/transport/our-vision-transport/mayors-transport-strategy-2018#:~:text=The%20Mayor's%20Transport%20Strategy%20sets,to%20it%20in%20November%202022.).
