Thank you for your request received by us on 21 April 2022 asking for CCTV footage from Brentford Station.
Your request has been considered in accordance with the requirements of the Freedom of Information Act ad our information access policy. I can confirm that we hold the information you have requested.
I have discussed your request with our CCTV Data Manager. He informs me that we received a request from the British Transport Police (BTP) from the same location, date and times. It is not TfL practice for staff to review footage where a potential crime may have been committed. Rather, this would be a matter for the police.
Under section 40(2) of the Freedom of Information Act we are unable to release the footage to you as release of this information would allow a third party to be identified which would be unfair. In this instance we believe that it would be unfair on the individual(s) concerned for images of themselves to be released.This is particularly true given that release of material under FOI has to be considered as release to the world at large - rather than to the individual applicant - and hence potentially accessible to anyone. Therefore the potential for identification is considered on that basis. We also believe that release of such footage would be unfair, given that a crime may have been committed.
This exemption to the right of access to information is an absolute exemption and not subject to an assessment of whether the public interest favours use of the exemption.
