Thank you for your request received by Transport for London (TfL) on 11 April 2023 asking for information about the procurement of Change Programme Partner.

Your request has been considered in accordance with the requirements of the Freedom of Information Act and our information access policy.  I can confirm that we hold the information you require. You asked: Please provide copies of any supporting documentation (including the scope / statement of work) and any correspondence relating to the procurement of a change programme partner on ref TfL95742

The procurement of this contract was a call off from the CCS MCF3 Framework  - information/link to the ‘CCS MCF3 Framework’ documentation can be found at the following link: https://www.crowncommercial.gov.uk/agreements/RM6187.

In accordance with the FOI Act, we are not obliged to supply some of the information requested as it is subject to a statutory exemption to the right of access to information under section 43(2).

In this instance the section 43(2) exemption has been applied as disclosure of the Appendix A – Statement of Requirements and Appendix 1 of the ITT document and the tender submissions themselves, would or would be likely to prejudice both our commercial interests, as well as those of the current supplier, Deloitte LLP respectively. These documents contain information on the target operating model design, process design and more importantly people change and disclosure of this information would disadvantage the supplier in their ability to participate in future competitive bidding processes for similar contracts with TfL and other organisations as well as hinder TfL’s ability to negotiate the best value for money for similar services in the future. The tender submissions and associated correspondence would also contain detailed costing and scoring information which would also prejudice the commercial interests of TfL and the suppliers who have submitted tenders.

The use of this exemption is subject to an assessment of the public interest in relation to the disclosure of the information concerned. We recognise the need for openness and transparency by public authorities, particularly where the expenditure of public money is concerned, but in this instance the public interest in ensuring that we are able to obtain the best value for public money outweighs the general public interest in increasing transparency of our processes.

The tender however was run compliantly under the CCS RM6008 Management Consultancy Framework Two.
