Thank you for your email received by Transport for London (TfL) on 8 April 2019.
Your request has been considered in accordance with the requirements of the Freedom of Information (FOI) Act and TfL’s information access policy. You asked:
Has Ola applied for an operators licence and if so can you provide me with a copy of the application form?
Please note that in accordance with Section 41(2) we are not obliged to confirm or deny whether we hold information relating to applications that may or may not currently be being processed.
Additionally, section 41(1) of the FOI Act is an exemption where information has been provided to a public authority in confidence. Although the private hire operator licence application form advises applicants that details of their licence, if granted, will be held on a public register, no indication is given that this information will be disclosed to the public prior to the grant of the licence. As applicants for a private hire operator licence have a reasonable expectation of confidentiality when they submit their application we are not obliged to provide this information if it were held. This confidentiality would additionally be breached if we were to confirm or deny whether the information was held.
As section 41 is an absolute exemption we have not gone on to consider the public interest test.
