Thank you for your request received by Transport for London (TfL) on 8th April 2024 asking for a copy of Compulsory Purchase Order Notice 53 Greek Street W1D 3DR. Your request has been considered in accordance with the requirements of the Freedom of Information Act and our information access policy.
Specifically you asked:
“Please may I be provided either a copy of or details of how to obtain the compulsory purchase order notice as detailed below:
Street Record - Soho Square, Greek Street Compulsory Purchase Order Notice dated 26.10.2011 [All that Stratum of subsoil that lies beneath 736.6 square metres, or thereabouts, of part of part of public highway (Soho Square and Greek Street), the upper extremity of which is 15.1 metres above Ordnance Survey Datum and the lower extremity of which is 6.8 metres below Ordnance Survey Datum] Compulsory Purchase (Vesting Declarations) Act 1981 and Crossrail Act 2008 TLC Ref: CP882330.”
Please note, there were no such notices served with reference to 53 Greek Street. With reference to the details above for “All that Stratum of subsoil that lies beneath 736.6 square metres, or thereabouts, of part of part of public highway….”, the Schedule of Acquisition Interests (SofAI) details the results of the land referencing searches conducted at the time of the acquisition and revealed that the subsoil ownership beneath the highway was ‘Unknown’ and, as such, a notice could not be generated and served upon an unknown party. The subsoil was, nevertheless, acquired.
I have attached the ‘sealed’ GVD Schedule and Plan for reference. Plot No 1309 of the GVD is the relevant description. The Local Planning Authority (Westminster City Council) will have been notified by way of a cover letter informing the LPA of the making of the GVD. These details, including the text for Plot 1309, will have been entered in the Local Land Charges register at WCC. The TfL land ownership details from the GVD, the acquired subsoil, will have been registered at H.M. Land Registry, an ‘e-copy’ of which can be purchased by anyone at minimum cost. The TfL Registered Title reference is NGL926177 should you wish to purchase a copy.
Please see the attached information sheet for details of your right to appeal as well as information on copyright and what to do if you would like to re-use any of the information we have disclosed.
Yours sincerely,
