Racism on TFL services

1. The number of reports of racism by police officers, volunteers or staff recorded by on TFL services 2016, 2017, 2018 and 2019
And for each report, I would like to know:

3. The outcome of the internal misconduct case
4. The outcome of any criminal investigation or proceedings arising from the report

Thank you for your request received by Transport for London (TfL) on 5th April 2019 asking for information about reports of racism on TfL services.
Your request has been considered in accordance with the requirements of the Freedom of Information Act and our information access policy. Specifically you asked to know:
“1. The number of reports of racism by police officers, volunteers or staff recorded by on TFL services 2016, 2017, 2018 and 2019
And for each report, I would like to know:
2. A brief description of the incident or offence alleged, that does not give any personal or identifying information (if you cannot provide this, please leave this out).
3. The outcome of the internal misconduct case
4. The outcome of any criminal investigation or proceedings arising from the report.”
Following my requests for clarification you stated that:
“The request relates to reports by police officers, volunteers or staff about alleged racism by others”, and;
“The request is regarding anyone who is under TfL's employment at the time, such as employees, volunteers AND any police officers operating on TFL's network. The emphasis would be on the former (employees and volunteers etc).”
I can confirm that we hold the information you require. However, to provide it would exceed the ‘appropriate limit’ of £450 set by the Freedom of Information (Appropriate Limit and Fees) Regulations 2004.
Under section 12 of the FOI Act we are not obliged to comply with a request if we estimate that the cost of determining whether we hold the information, and then locating and retrieving it, or extracting it from other information, would exceed the appropriate limit. This is calculated at £25 per hour for every hour spent on the activities described, which equates to 18 hours work.
In order to collate this information we would have to check individual HR records and read the case notes to ascertain exactly who and what each case specifically related to. In the years since 2016 this would mean reviewing 795 separate records (note that TfL employs around 27,000 people). Even at a conservative estimate of 5 minutes per file, this would equate to over 66 hours of work. Providing a written description of the incident or alleged offence and the outcome would take longer still.
To help bring the cost of responding to your request within the £450 limit, you may wish to consider narrowing its scope so that we can more easily locate, retrieve and extract the information you are seeking, bearing in mind the information above.
Please note that we will not be taking further action unless we receive a revised request.
