Potholes: stats, procedure and compensation

Thank you so much for helping me with a recent request regarding pothole claims and compensation. It would be great to know if we can ask for a couple more pieces of information about this? Out of the claims that you have received from damage caused by potholes, would you be able to let us know how many of these are still in progress and how many have been turned down for the last three years figures are available?

Thank you for your email received by Transport for London (TfL) on 7 April 2020, asking about pothole related compensation claims.

Your request has been considered in accordance with the requirements of the Freedom of Information Act and our information access policy.  I can confirm we do hold the information you require. You asked:

Out of the claims that you have received from damage caused by potholes, would you be able to let us know how many of these are still in progress and how many have been turned down for the last three years figures are available?

Please note we have used the same cut of data that we used when we responded to your first request.

Of the 654 pothole related claims between 1 January 2017 and 31 December 2019, a total of 98 were ‘open’ at the time of our first response.

516 claims had been denied on behalf of TfL at the time of our first response, although some of these may have been redirected as we explained previously.  

Highway maintenance on our roads is carried out under the London Highways Alliance Contracts (LoHAC), if there is an alleged or possible failure that would lead to a compensation claim, that claim would be passed to the highway contractor to handle. We do not hold information on which of those are paid or how much is paid out.
