Thank you for your request received by Transport for London (TfL) on 3 April 2018 asking for information in relation to the successful ten qualifying bids for ADUP2, Lot 1 and Lot 10. I apologise for the delay in replying.

Your request has been considered in accordance with the requirements of the Freedom of Information Act and our information access policy. I can confirm that we hold the information you require.  You asked for copies of all information in relation to the successful ten qualifying bids for ADUP2, Lot 1 and Lot 10 respectively.

In accordance with the FOI Act, we are not obliged to supply some of the information as it is subject to a statutory exemption to the right of access to information under section 43(2). In this instance the section 43(2) exemption has been applied  to information which if disclosed would significant prejudice both TfL’s and its third party bidders commercial interests.  Disclosures made under FOI are considered to be ‘disclosures to the world at large’. The release of detailed information surrounding pricing structures and individual technical design submissions would diminish third party bidders ability to tender for similar contracts as well as future contracts with TfL, if certain details surrounding their tender submissions were to published into the public domain, allowing their competitors to see the information and therefore meaning they could not compete in a competitive marketplace.

Additionally it would prejudice TfL’s ability to obtain the best value for public money if it were known what pricing negotiations were agreed, putting us at a disadvantage when the contract was due for renewal. Along with the issue that suppliers would be less likely to bid for our contracts if they know that their commercial information could be disclosed to their competitors.

The use of this exemption is subject to an assessment of the public interest in relation to the disclosure of the information concerned. We recognise the need for openness and transparency by public authorities, particularly where the expenditure of public money is concerned, but in this instance the public interest in ensuring that we are able to obtain the best value for public money outweighs the general public interest in increasing transparency of our processes.
