Thank you for your email received by Transport for London (TfL) on 3rd April 2020 about outdoor advertising.

Your request has been considered in accordance with the requirements of the Freedom of Information Act and our information access policy.

I can confirm that we hold the information you require. Your questions are answered in turn below:

Question 1: Do you have a contract (or contracts) for outdoor advertising and/or advertising on street furniture? This includes contracts for the provision and/or maintenance of bus shelters and/or street furniture where advertising is a component of the contract.

Answer: Yes.

Question 2: If yes, for each contract, please supply

A - Title of contract

Answer: Advertising Shelter Concession

B - Name of supplier

Answer: JCDecaux UK Limited

C - Start date

Answer: 1st January 2016.

D - End date

Answer: 31st December 2020.

E - Date(s) of any extension option(s)

Answer: 3 years to 31 Dec 2023 – (please note that this extension option has been exercised so the contract will run to the end of 2023).

Question 3: A copy of the specification, as it was advertised

Answer: See attached document “Annex A….”.


Question 4: The contract award report (or equivalent) required by Regulation 84(1) of the Public Contract Regulations

Answer: See attached document “Annex B….”. Note that any names that appear in the document have been redacted under section 40(2) of the Freedom of Information Act, the exemption relating to the unfair release of personal information. Further, any financial information has been redacted under section 43(2) of the Freedom of the Information Act, the exemption relating to commercial interests. Under section 43(2), information is exempt from release if release would, or would be likely to, prejudice the commercial interests of the public authority itself or any third party. The exemption is “qualified”, meaning that its application is subject to a consideration of whether it is in the greater public interest for the exemption to apply or for the information to be released in any case. In this case we believe that the public interest is best served by withholding the information. While we appreciate the need for openness and transparency in the operation of our business and in the spending of public funds, we believe that this is outweighed by the fact that release of the information would prejudice any future negotiations for such a contract, to the detriment of the public purse. The majority of TfL funding comes from grants and fares. It is therefore critical that we are able to protect the public purse by ensuring that we enter into future contractual negotiations with the ability to secure the best value for money. Release of this information into the public domain would constrain our ability to do that. Similarly, release of the information would be likely to prejudice the bidders commercial interests by revealing information that would be of use to their competitors, potentially opening TfL up to legal challenge. For these reasons we believe the exemption is rightfully applied in the public interest.


Question 5. Details of the fee structure agreed with the successful supplier, to include:

a) Fee payable by the supplier to the authority, per annum, for each item of advertising equipment. Please provide this on an itemised basis for each type of advertising equipment, e.g. advertising shelter, digital bus shelter, digital freestanding panels, council information panels, other (specify)

b) Details of any revenue/gain share agreements not covered by the fee structure above, such as commitment to pay the greater amount of a minimum guarantee or total net revenues

Answer: The information is exempt from disclosure under section 43(2) of the Freedom of Information Act, for the same reasons cited above in answer to question 4.
