I would like to request information relating to lower limb fractures sustained by members of the public whilst using Transport for London services, including stations managed by TfL. I would like to know the individual settlement amounts paid out to claimants in 2017, 2018 (and if permitted within the time restriction of this request, 2019 and 2020). This is for payments made during this time, and not necessarily when the injury occurred.

Thank you for your request of 1st April 2022 asking for information about injury claims made against TfL.

Your request has been considered in accordance with the requirements of the Freedom of Information Act and our information access policy. 

Specifically you asked:

I would like to request information relating to lower limb fractures sustained by members of the public whilst using Transport for London services, including stations managed by TfL.

I would like to know the individual settlement amounts paid out to claimants in 2017, 2018 (and if permitted within the time restriction of this request, 2019 and 2020). This is for payments made during this time, and not necessarily when the injury occurred.

I can confirm that we hold the information you require. Data aggregated by year is given below:

In 2017 there were 8 claims paid totalling £55,127;

In 2018 there were 9 claims paid totalling £332,876.70 (note that 2 of these also appear in the 2017 count, but further payments were made in 2018);

In 2019 there were 3 claims paid totalling £72,400. (1 of these also appear in the 2017 count, but further payments were made in 2019);

In 2020 there were 2 claims paid totalling £25,552.30.

In terms of the request for the data to be split by “individual settlement amounts”, please note that in accordance with TfL’s obligations under Data Protection legislation we are refusing provision of this information, as required by section 40(2) of the FOI Act. This is because disclosure of this personal data would be a breach of the legislation, specifically the first principle which requires all processing of personal data to be fair and lawful. It would not be fair to disclose this personal information when the individuals have no expectation it would be disclosed and TfL has not satisfied one of the conditions which would make the processing ‘fair’.
