Thank you for your letter received by Transport for London (TfL) on 16 February 2018 concerning your penalty fare notice appeal.

The part of your letter asking for personal information about TfL’s employees has been processed in accordance with the Freedom of Information Act 2000 and our information access policy. You asked for:

  1. The full name and home address of the person residing over this decision.

     

  2. The full name and home address of the issuing ticketing agent.

     

  3. What legal qualifications does the Youth and Penalty Fares Manager have in determining legislative legalese

I can confirm we do hold the information you require.

The name of the Penalty Fare and Youth Appeals Manager is David Cassettari and he holds a Masters Degree in Advanced Investigative Practices. The name of the Revenue Inspector is Sarah Wallis.

However, in accordance with the FOI Act, we are not obliged to supply you with the rest of the information about these individuals as they are subject to a statutory exemption to the right of access to information, under section 40(2) of the Act.

In this instance the exemption has been applied as the information you have requested constitutes the individuals’ personal data. Disclosure of this personal data would be a breach of the Data Protection Act (DPA), specifically the first principle of the DPA which requires all processing of personal data to be fair and lawful. It would not be fair to disclose this personal information when the individuals have no expectation it would be disclosed and TfL has not satisfied one of the conditions of Schedule 2 of the DPA which would make the processing lawful.

This exemption to the right of access to information is an absolute exemption and not subject to an assessment of whether the public interest favours use of the exemption
